Terms of Use

1. Agreement and eligibility

These Terms govern your use of the LewdByte website, account service, downloads, and Windows application operated by LewdByte. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy. You must be at least 18 years old and legally able to enter this agreement.

2. Free software and voluntary donations

LewdByte is offered free of charge and does not charge per message. Any donation is voluntary and does not purchase software, a model, a service, priority support, access, or additional rights. Unless a separate written license says otherwise, you may install and use the official application for personal, lawful purposes under these Terms.

3. Local application and account access

AI inference, conversations, contacts, and character memory are designed to run and stay on your device. A web account is required to activate the application, maintain a trusted device session, and access official downloads. Temporary offline access does not guarantee permanent availability of the account service, third-party sources, or every application feature.

4. Third-party models and runtimes

Model weights are not included in the LewdByte installer and are not hosted or mirrored by LewdByte. The app may display compatibility information and links that let you fetch a model from a source identified before download, or you may import your own compatible files. Runtime packages may be distributed separately from the installer and can include third-party components.

• Third-party models, runtimes, names, and trademarks belong to their respective authors and owners.
• Each download remains subject to its own source terms, model card, acceptable-use rules, and license. LewdByte does not grant rights that a third-party owner has not granted.
• You are responsible for checking that your intended use, hardware, content, and jurisdiction comply with those terms and applicable law.
• A catalog entry or compatibility label is provided for convenience. It is not an endorsement, warranty, safety certification, or promise that a source will remain available.

LewdByte did not create, train, or control a third-party model merely because the app can download, import, or run it. Model authors and hosts may change or remove their files and terms at any time.

5. AI output and risk

Responses are generated locally by the model you select, using the contacts, prompts, memory, and settings you control. They are synthetic output, not statements by a human or by LewdByte. A model may produce false, biased, offensive, explicit, disturbing, unlawful, or otherwise harmful material, including confident misinformation.

LewdByte does not promise to review, filter, monitor, or approve local conversations and cannot guarantee the accuracy, safety, legality, or suitability of third-party output. Do not treat model output as medical, legal, financial, mental-health, emergency, or other professional advice. Use independent judgment and qualified help where decisions could affect health, safety, rights, or money.

6. Your content and voice data

You retain responsibility for prompts, character data, images, audio, voice references, imported files, and anything you create or share using the app. Use only material you have the right and, where relevant, the person's consent to use. Local storage does not make unlawful use lawful or remove third-party privacy, publicity, copyright, or other rights.

7. Prohibited use

You must not use LewdByte to:

• Break the law, violate another person's rights, or facilitate real-world harm.
• Create, possess, or distribute child sexual abuse or exploitation material, or sexual content involving any person under 18.
• Create or distribute non-consensual intimate material involving an identifiable real person.
• Attack, bypass, overload, reverse engineer for abuse, or gain unauthorized access to LewdByte infrastructure or another account.
• Distribute malware, stolen credentials, or content you have no right to use.

8. Account security

Keep your password and devices secure, provide accurate account information, and tell us promptly about suspected unauthorized access. You can revoke trusted desktop sessions from your account. We may suspend or revoke access when reasonably necessary to secure the service, enforce these Terms, comply with law, or prevent abuse.

9. Ownership

LewdByte branding, original interface, documentation, and original assets remain owned by LewdByte or their respective licensors. Third-party components and models remain governed by their own notices and licenses. These Terms do not transfer ownership of any third-party model to LewdByte or to you.

10. Availability and changes

The service is provided on an “as available” basis. Features, hardware compatibility, runtime packages, catalog entries, and external download sources may change. We may release updates, discontinue obsolete versions, or interrupt online services for maintenance, security, legal, or operational reasons. Keep backups of local data you do not want to lose.

11. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, LewdByte is provided “as is” without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, non-infringement, model quality, or output safety. LewdByte is not responsible for the design, training data, license, availability, conduct, or output of third-party models and services.

To the maximum extent permitted by law, LewdByte will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profit, reputation, or opportunity arising from third-party models, generated output, local files, user configuration, or reliance on the service. Nothing in these Terms excludes liability that cannot legally be excluded, including mandatory consumer rights or liability arising from fraud, willful misconduct, or other non-waivable grounds.

12. Termination and changes to these Terms

You may stop using LewdByte at any time and may request account deletion. Sections that by their nature should survive termination — including third-party licenses, ownership, disclaimers, and liability limits — remain effective. We may update these Terms when the service or legal requirements change. Material changes will be posted with a new effective date and, where appropriate, additional notice.
